The material that was posted is not in violation of copyright infringement. It is marketing material provided by Dave's Insanity Sauces. Please check any number of hot sauce sites to validate it.

Under present copyright law, everything is automatically under copyright unless it's earlier than 1923 or it says it's NOT under copyright or there are special circumstances.
Unless there is a notice explicitly putting it in the public domain or releasing it under the GFDL license, we can't use it. If it is marketing material, then it is very likely that the company wishes to control its use and would be prepared under some circumstances to assert their copyright claims if it was used in a way they did not like. Wikipedia requires everything submitted to be under GFDL which, among other things lets us use it in any way we see fit. Wikipedia does not accept "used by permission" material, material requiring a credit line, etc.
Try contacting Dave's PR department and asking them whether they will release it under the GFDL. You need to explain at least briefly that the GFDL is a specific license and telling them where they can read it. If the object is to actually get a meeting of the minds I have found it helpful to say that releasing it under GFDL is "a license that permits free use and is in many ways similar to placing it in the public domain." What most mainstream organizations need to understand is that they cannot assert control over material placed in Wikipedia. If you can get them to say, in so many words, "it is in the public domain," then that's OK and we can use it. It is sometimes easier to get people to agree to that than to take them through the intricacies of the GFDL.
They will probably respond by saying that it can be used by permission and setting conditions on its use. For example, they may say that we need to include a credit line or something of that sort. Any such response means we can't use it.
Your chances of getting them to specifically release it under GFDL or to say it is in the public domain are very small, but it's worth trying.
